Court judgement partially confirms patent infringement

Ventomaxx GmbH, a leading company in the field of decentralised ventilation technology from Landshut in Lower Bavaria, has won a partial victory. Following a protracted legal dispute with Airoluxx GmbH concerning indirect patent infringements, the Munich I Regional Court has now issued a judgement and upheld the first part of Ventomaxx GmbH’s claim. In a judgement that is not yet final, the court found that the offer and sale of certain products of Airoluxx GmbH indirectly infringed a patent of Ventomaxx GmbH. The second part of the action concerning further products of Airoluxx GmbH, in respect of which the court denied patent infringement in the first instance, will be pursued further in the next instance in order to have the opinion of Ventomaxx GmbH confirmed in this respect as well.
